Although elements of the act have been modernised over time, the act stems from 1895. Therefore the Dutch Ministry of Justice and Security initiated a consultation about a comprehensive vision on modern Dutch insolvency law.
As the largest group of dedicated insolvency lawyers in the Netherlands it was logical for NautaDutilh's Restructuring & Insolvency team to contribute by sharing its views on this interesting area of law. The ministry identified specific issues, but parties were also invited to share a broader view on insolvency law in general. NautaDutilh's response can be read here.
