In its judgments, the Court of Appeal affirmed the jurisdiction of the arbitral tribunals to hear the investors' claims in relation to the Russian Federation's unlawful expropriation of their investments in Crimea on the basis of the Ukraine-Russia Bilateral Investment Treaty.
The judgments in these three proceedings are a victory for the investors in specific and for the rule of law in general, as they entail that the Russian Federation will be held liable for its illegal conduct in Crimea.
NautaDutilh is proud to have represented the Ukrainian investors throughout these proceedings. Mirjam van de Hel - Koedoot led NautaDutilh's arbitration team, which further consisted of Freerk Vermeulen, Pieter Fritschy, Aalt Colenbrander and Tetyana Makukha.
