Many regions, including most EU member states, have foreign direct investment screening mechanisms to protect national security. These include both general and sector-specific screenings. The Benelux countries also have their own FDI regimes with varying scopes:

  • In The Netherlands, the Investments, Mergers, and Acquisitions (Security Screening) Act, a comprehensive investment screening regime, became effective on 1 June 2023.
  • In Belgium, foreign direct investment (FDI) legislation was enacted on 1 July 2023.
  • In Luxembourg, foreign direct investment (FDI) legislation came into effect on 1 September 2023.

These regimes require certain investments and require notification with and approval from the relevant authorities, prior to finalising the investment.
